General Release of Liability, Terms & Conditions for All Events
PLEASE READ CAREFULLY: THIS IS A LEGALLY ENFORCEABLE WAIVER OF RIGHTS
Release of Liability Thank you for participating in "Take a Break" weekend, a 2019 Philosophers Camp event (“Event”), which consists of a 3-day, 2-night retreat, by Philosophers Camp, LLC and co-facilitated by Christine Powers, owner and CEO, and guest facilitator Ben Gioia (“Teachers") with the support of independent contractors and volunteers. The Event provides the opportunity for participants to explore their personal development, see the landscape of New Glampshire in the Town of Johnsburg, NY and surrounds, and join other Event participants for the weekend. By participating in the Event you agree to the following:
The information presented is educational and entertaining in nature and is provided as general information and is not medical or psychological advice. You understand this experiential Event focuses on personal growth and tourism and is not to be considered treatment for any physical, emotional, or mental disorder. You agree to consult with your health care providers for medical, emotional, or psychological problems or issues. You understand that Philosophers Camp, LLC makes no warranty, guarantee, or prediction regarding any outcome for you during or after the Event. You understand that you may voluntarily reveal personal information and you waive your rights of privacy and confidentiality.
You acknowledge that you have voluntarily applied to participate in the event designated above. You are voluntarily participating in the retreat with knowledge that travel involves numerous risks and dangers including, but not limited to, a risk of illness, injury or death, which may be caused by: forces of nature, civil unrest, terrorism, road conditions, injuries inflicted by animals, insects, reptiles or plants, trails, hotels, vehicles, boats or other means of conveyance; high altitude accident, accident or illness without access to means of rapid evacuation or the availability of medical supplies; and the lack of adequacy of medical attention once provided. You assume the risk of negligence on the part of Philosophers Camp, LLC, Christine Powers, Larry Powers, Ben Gioia, affiliated organizations and their employees, teachers, volunteers or other agencies in connection with said retreat.
YOU HEREBY ACCEPT ANY AND ALL RISKS OF ILLNESS, INJURY, EMOTIONAL TRAUMA OR DEATH
You agree and understand the Event may be photographed and/or recorded and that Philosophers Camp, LLC shall have rights in and to such photographs and/or recording, including the copyright. Copyright shall include, and not be limited to, the right to use and publish and reproduce, modify, and display photography and/or recordings for promotional purposes. You grant Philosophers Camp, LLC the rights, without compensation to you, to photograph and/or record you while participating in the Event and you waive any right in any photograph and/or recording. You do have the option to opt-out of any photography and filming and can do so by sending an email to campercare@philosopherscamp.com prior to the start of the Event. You understand that your participation in the Event is strictly voluntary, at your own risk, and that you freely choose to participate. You agree to take full responsibility for your self-care and safety.
You agree and understand that this Release of Liability and Terms & Conditions (“Agreement”) are intended to be a complete unconditional release of liability and assumption of risk to the greatest extent permitted by law in the State of New York. You represent that you're competent and able to understand the consequences of participating in the Event and that you are an adult under the laws of the municipality of your residence and you have the right to enter into this agreement.
Any and all matters in dispute between the parties to this Agreement, whether arising from or relating to the Agreement itself, or arising from alleged extra-contractual facts prior to, during, or subsequent to the Agreement, including, without limitation, fraud, misrepresentation, negligence or any other alleged tort or violation of the contract, shall be governed by, construed, and enforced in accordance with the laws of Warren County in the State of New York in the United States. If any portion of this Agreement is held to be invalid, it is agreed that the balance of the Agreement shall continue in full force and affect.
By completing your registration process, you acknowledge that you have completely read and understand all aspects of this Agreement and you agree to all of the terms and conditions. This Agreement shall be binding upon you and your heirs, family, legal representative, successors, and assigns. You and your heirs agree to fully release, indemnify, hold harmless, and defend, Philosophers Camp, LLC, Christine Powers, independent contractor Ben Gioia, any independent contractors providing any support services, volunteers, and others associated with them from all claims or liability, of whatsoever kind, and for any damage or injury which you may incur arising at any time as a result of your voluntary decision to participate in the Event.
If any portion of this agreement is unenforceable, the remaining portions shall remain in full force and effect. Under no circumstances shall Philosophers Camp, LLC be liable to any retreat participant for more than the land cost of the retreat applied for on this document. You waive any charge-back rights and, in the event of dispute, requests for a refund will be made using the procedures described under the “Refund & Cancellation Policy” section below. All applications are subject to acceptance by Philosophers Camp, LLC. Upon acceptance of your application and a completed registration process, this agreement shall be deemed to have been entered into at the Town of Johnsburg in New York and shall be construed according to the laws of the State of New York.
