Terms & Conditions for Philosophers Camp
PLEASE READ CAREFULLY: THIS IS A LEGALLY ENFORCEABLE WAIVER OF RIGHTS
Release of Liability Thank you for participating in the Philosophers Camp (“Event”), which consists of a multi-day retreat week offered at Asa Adirondack in Johnsburg, NY, and in conjunction with Synchronicity Calling, LLC and Asa Adirondack. Facilitated by a combination of Christine Powers, Pat Duckworth, Larry Powers, and others to be named (“Teachers") with the support of volunteers. The Event allows participants to explore their spirituality, see the landscape of the Adirondack Mountains, and join other Event participants for the Event. By participating in the Event, you agree to the following:
Any information presented is educational and entertaining in nature and is provided as general information, and is not intended to be nor should replace medical or psychological advice. You understand this experiential Event focuses on personal growth and sacred tourism and is not to be considered a treatment for any physical, emotional, or mental disorder. You agree to consult your healthcare providers for medical, emotional, or psychological problems or issues. You understand that Synchronicity Calling, LLC, Asa Adirondack, and the facilitation team make no warranty, guarantee, or prediction regarding any outcome for you during or after the Event. You understand that you may voluntarily reveal personal information. You understand and agree to sign a Confidentiality Agreement among all participants and staff. Teachers, staff, and volunteers will do all possible to ensure your privacy and confidentiality rights.
You acknowledge that you have voluntarily applied to participate in the Event designated above. You are voluntarily participating in the Event with the knowledge that travel involves numerous risks and dangers, including, but not limited to, a risk of illness, injury, or death, which may be caused by: forces of nature, civil unrest, terrorism, viruses and bacteria, road conditions, injuries inflicted by animals, insects, reptiles or plants, trails, hotels, vehicles, boats or other means of conveyance; high altitude accident, accident or illness without access to means of rapid evacuation or the availability of medical supplies; and the lack of adequacy of medical attention once provided. You assume the risk of negligence on the part of Synchronicity Calling, LLC, Christine Powers, Larry Powers, Pat Duckworth, their affiliated organizations, and any employees, teachers, volunteers, or other agencies in connection with said Event.
YOU HEREBY ACCEPT ANY AND ALL RISKS OF ILLNESS, INJURY, EMOTIONAL TRAUMA, OR DEATH
You agree and understand the Event may be photographed and/or recorded and that Synchronicity Calling, LLC shall have rights in and to such photographs and/or recording, including the copyright. Copyright shall include, and not be limited to, the right to use and publish and reproduce, modify, and display photography and/or recordings for promotional purposes. You grant Synchronicity Calling, LLC the rights, without compensation to you, to photograph and/or record you while participating in the Event. You waive any right in any photograph and/or recording. You do have the option to opt out of any photography and filming and can do so by sending an email to stay@asaadirondack.com before the start of the Event. You understand that your participation in the Event is strictly voluntary, at your own risk, and that you freely choose to participate. You agree to take full responsibility for your self-care and safety.
You agree and understand that this Release of Liability and Terms & Conditions (“Agreement”) is intended to be a complete unconditional release of liability and assumption of risk to the greatest extent permitted by law in the State of New York. You represent that you're competent and able to understand the consequences of participating in the Event and that you are an adult under the laws of the municipality of your residence. You have the right to enter into this agreement.
Any and all matters in dispute between the parties to this Agreement, whether arising from or relating to the Agreement itself, or arising from alleged extra-contractual facts before, during, or after the Agreement, including, without limitation, fraud, misrepresentation, negligence, or any other alleged tort or violation of the contract, shall be governed by, construed, and enforced in accordance with the laws of Warren County in the State of New York in the United States. If any portion of this Agreement is held to be invalid, it is agreed that the balance of the Agreement shall continue in full force and effect.
By completing your registration process, you acknowledge that you have completely read and understand all aspects of this Agreement and agree to all of the terms and conditions. This Agreement shall bind you and your heirs, family, legal representative, successors, and assigns. You and your heirs agree to release, indemnify, hold harmless, and defend fully, Synchronicity Calling, LLC, Christine Powers, Asa Adirondack, Pat Duckworth, any independent contractors providing any support services, volunteers, and others associated with them from all claims or liability, of whatsoever kind, and for any damage or injury which you may incur arising at any time as a result of your voluntary decision to participate in the Event.
If any portion of this agreement is unenforceable, the remaining portions shall remain in full force and effect. Under no circumstances shall Synchronicity Calling, LLC be liable to any retreat participant for more than the land cost of the retreat applied for on this document. You waive any charge-back rights, and, in the event of a dispute, requests for a refund will be made using the procedures described below in the “Refund & Cancellation Policy” section. All applications are subject to acceptance by Synchronicity Calling, LLC. Upon acceptance of your application and a completed registration process, this agreement shall be deemed to have been entered into at the Town of Johnsburg in New York and shall be construed according to the laws of the State of New York.
